1. Acceptance of Terms

By accessing and using the website located at www.palliativereiki.ca  (the "Site") and engaging with the services offered by Jacqueline Gignac (referred to as "we," "us," or "our"), you signify your agreement to be bound by these Terms and Conditions ("Terms"). If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. These Terms constitute a binding legal agreement between you and us.

Palliative Reiki with Jacqueline Gignac provides Reiki energy healing sessions (in-person and virtual), compassionate companionship services, workshops, and related wellness resources] (collectively, "Services"). We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without notice.

3. Client Responsibilities & Disclaimers

  • Accuracy of Information: You agree to provide accurate, current, and complete information when booking services or interacting with our Site.

  • Health & Medical Disclaimer: You understand and acknowledge that Reiki is a complementary healing modality and is not a substitute for professional medical, psychological, or psychiatric care. We do not diagnose, treat, or cure any medical conditions, nor do we prescribe medications. It is recommended that you continue to see a licensed physician or healthcare professional for any physical or psychological ailments you may have. Our compassionate companionship services are for social, emotional, and practical support and do not constitute medical or personal care,

  • Personal Responsibility: You are solely responsible for your own well-being and decisions made before, during, and after engaging with our Services.

  • Comfort & Safety: During in-person sessions, you agree to communicate any discomfort or concerns immediately. Inappropriate conduct, such as abuse or aggression of any kind by the client is strictly prohibited and will result in immediate termination of the session without refund.

4. Booking, Payments, and Cancellations

  • Booking: All Services must be booked in advance through our Site or by contacting us directly.

  • Payment: All payments for Services are due at the time of booking or as otherwise agreed upon. We accept major credit cards and e-transfer. All prices are listed in Canadian Dollars (CAD) unless otherwise specified.

By booking a session, you agree to adhere to this policy. Failure to provide adequate notice for cancellations or no-shows may result in a forfeiture of your session fee or a session from your package.

5. Virtual Sessions

  • For virtual sessions conducted via platforms like Zoom, you are responsible for ensuring you have a stable internet connection and a private, quiet space free from distractions. We are not responsible for technical issues on your end that may disrupt a session.

6. Intellectual Property

  • All content on this Site, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Jacqueline Gignac  or its content suppliers and protected by Canadian and international copyright laws.

  • You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or Services without express written permission from us.

7. User Accounts

  • If you create an account on our Site, you are responsible for maintaining the confidentiality of your account information and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

  • To the fullest extent permitted by applicable law, in no event shall Jacqueline Gignac Palliative Reiki, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

11. Indemnification

  • You agree to defend, indemnify, and hold harmless Jacqueline Gignac, Palliative Reiki and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms; or c) any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site using your account.

12. Governing Law

  • These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada, for the resolution of any disputes.

13. Severability

  • If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
